1. Services Provided:
These Terms of Service apply exclusively to customers located in Harris County and Galveston County, Texas. Your Home Company LLC may expand services to additional locations in the future at their discretion. Customers will be notified through direct account notifications, email, and updates on the company website to ensure they remain informed of any changes. 2. Account Types and Subscription Models:
Customers may access services through different account types tailored to their maintenance needs:
Your Home Company LLC: Offers FREE and PREMIUM accounts. PREMIUM accounts, costing $299 per year, provide exclusive benefits such as two annual maintenance visits, access to specialized services, priority scheduling, seasonal maintenance, and emergency response access. Customers in the PREMIUM plan receive preemptive care to prevent major breakdowns and prolong the lifespan of household systems.Your Home Company LLC: Services are available under a subscription model, effective from the Subscription Start Date. Customers can terminate their subscription with fifteen (15) days’ written notice. Your Home Company LLC’s subscription covers regular system checks and minor repairs, helping customers avoid costly emergency repairs.
3. User Obligations:
Customers are expected to:
Submit service requests via the designated app or website with a clear description of the issue.Provide timely responses to technician communications and appointment scheduling requests.Allow reasonable access to service areas and ensure pets are properly managed to prevent safety hazards.Have an informed adult present during service visits to address any immediate concerns or approvals.Refrain from requesting additional tasks outside of the approved request unless prior authorization has been granted.Avoid soliciting unauthorized services from technicians to maintain compliance with service provider policies.
Failure to comply with these obligations may result in service cancellation, additional charges, or termination of services.
4. Evaluation of Suitability:
Your Home Company LLC reserve the right to assess whether a property is suitable for service, based on factors such as safety, health concerns, or work conditions. If a home is deemed unsuitable for any reason, the provider may refuse service until the necessary conditions are met. Customers may be required to make modifications or repairs before service can proceed.
5. Payment Terms:
Customers will receive notifications before automatic payments are processed to avoid unexpected charges. Payments are due upon receipt of the invoice. If unpaid for ten (10) days, the default payment method will be charged, including a 10% gratuity (Your Home Company LLC).Subscription fees, service charges, and payments for third-party services must be made as applicable (Your Home Company LLC).Customers authorize automatic payments and are responsible for maintaining updated payment information in their account settings. Customers may update or revoke payment authorization at any time through their account settings or by contacting customer support, subject to any outstanding payment obligations.Unpaid balances may result in service suspension, late fees, and, if necessary, referral to external collection agencies, with customers liable for associated fees and costs.
6. Third-Party Services:
Your Home Company LLC may recommend or coordinate third-party contractors for services beyond their core offerings, such as landscaping, pest control, roofing, and major renovations. However, Your Home Company LLC assumes no responsibility for the conduct, performance, or outcomes of services provided by third-party contractors. Customers acknowledge that any agreements with third-party contractors are independent, and Your Home Company LLC shall not be liable for any claims, damages, or disputes arising from such services. Customers acknowledge that such services are subject to separate agreements, terms, and conditions with the third-party provider. Your Home Company LLC are not responsible for service outcomes, liability, damages, or disputes related to third-party contractors. Customers should thoroughly review third-party service agreements before proceeding.
7. Warranty and Liability:
Your Home Company LLC warrant that services will be performed by qualified professionals using industry-standard practices. Your Home Company LLC offers a limited warranty ensuring that all work performed will meet industry standards for a period of thirty (30) days. If deficiencies are identified within this period, Your Home Company LLC will, at its discretion, re-perform the service or offer an appropriate resolution. Your Home Company LLC are not responsible for pre-existing conditions, hidden defects, or damages resulting from lack of maintenance or improper use.Liability is limited to the total amount paid by the customer for services in the preceding 12 months, except in cases of gross negligence or willful misconduct by Your Home Company LLC, where liability may be subject to applicable state and federal laws. In no event shall Your Home Company LLC be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, data, or business opportunities, even if advised of the possibility of such damages. Customers agree that claims beyond this amount are not eligible for compensation.
8. Dispute Resolution:
Disputes between customers and Your Home Company LLC will be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. This arbitration clause is intended to comply with Texas consumer protection laws, and customers retain the right to seek mediation before arbitration if they choose. Additionally, small claims court remains an option for eligible disputes under Texas law.Customers waive the right to participate in class actions or have claims decided by a jury, except where such waivers are prohibited under Texas state law. This waiver does not apply in cases where statutory consumer protection laws expressly prohibit such limitations of legal recourse.The dispute resolution process aims for a fair, impartial resolution while minimizing legal costs for both parties.
9. Termination:
Your Home Company LLC reserve the right to terminate agreements if customers fail to meet payment terms, violate obligations, or engage in misconduct.Customers may terminate their services with 48 business hours’ written notice (Your Home Company LLC) or fifteen (15) days’ notice (Your Home Company LLC), provided that all outstanding balances are settled. Early termination may be subject to additional fees or penalties as outlined in the service agreement. These may include a prorated charge for unused services, administrative processing fees, or a flat early termination fee, depending on the stage of the subscription period and any costs incurred by Your Home Company LLC.Upon termination, all unused service benefits and remaining subscription periods are non-refundable, except in cases where the service provider fails to deliver agreed services as defined by a documented failure to complete scheduled or paid-for services within the agreed timeframe, despite reasonable opportunities to do so. 10. Confidentiality:
Both parties agree to maintain confidentiality of any non-public information related to the services provided, customer details, and operational processes. Your Home Company LLC will not share customer information with third parties unless required by law or with explicit customer consent.

Customers should review individual agreements with Your Home Company LLC and their potential partners, depending on what services are required. Each provider may have additional clauses specific to their services, including but not limited to response times, coverage limits, and refund policies. Customers are encouraged to read these agreements carefully before subscribing to a service plan to ensure full awareness of their rights and obligations.
